Terms Of Use
AGREEMENT
By viewing, accessing or using the CBHS Health Fund Limited (CBHS) website ('and any online or mobile app service (Site'), including any liked page or related content, you agree to be bound by and accept the following terms and conditions including any changes. Please note additional conditions of use apply to your use of the CBHS Member Centre and CBHS Mobile App.
SITE CONTENT
CBHS provides information and material on the Site (Content) for general information purposes only. The Content is factual information only and is not comprehensive.
While CBHS uses reasonable attempts to ensure the accuracy and completeness of the Content, to the extent permitted by law (including the Australian Consumer Law), CBHS does not warrant the accuracy, completeness, currency or suitability of any of the Content.
The Content may be subject to change without notice and CBHS does not undertake to keep the Site up-to-date. There may be defects, errors or omissions in the Content. CBHS also does not warrant that access to the Site will be uninterrupted, error-free or free from viruses.
CBHS does not accept liability to any person for the information or advice provided on the Site or incorporated into it by reference. You should not act or fail to act on the basis of the Content but should obtain appropriate independent advice.
The placement of material from other entities on the Site in no way serves as a warranty or representation by CBHS as to the fitness of such entities.
Calculators and Simulations
All results from calculators on the Site are simulations which are indicative approximations only and constitute neither an offer, nor a quote nor a pre-qualification for cover.
Health Benefit Fund Rules
All covers are subject to the CBHS Health Benefit Fund Rules (Rules), a copy of which can be obtained here or by contacting the CBHS Member Care Centre on 1300 654 123.
In the event of any inconsistency arising between the Site Content and the Rules, the Rules will prevail. The Rules and any benefit levels may change from time to time.
If you anticipate seeking treatment for which a claim may be payable by CBHS, you should contact CBHS in advance of the treatment to ascertain what, if any, benefit may be payable.
YOUR RISKS
You accept all risks relating to potential loss, damage or other consequences resulting directly or indirectly from your use of the Site. This includes, but is not limited to, the transmission of any computer virus. We recommend that prior to using any downloaded file, you carry out an appropriate virus check.
The Content is provided to you on the basis that you accept full responsibility for assessing its accuracy, currency, reliability and correctness and rely on it entirely at your own risk.
Members should only rely on their own enquiries and seek any assurances or warranties directly from the provider of a service or product.
SITE SECURITY
There is a risk that information sent to or from the Site may be intercepted, corrupted or modified by third parties. CBHS makes no warranty about the strength or effectiveness of the encryption of information sent across the Site and CBHS is not responsible for events arising from unauthorised access to information provided by users over the Site.
In using the Site you agree you will not seek to hold CBHS, its employees or agents liable for any unauthorised disclosure, damage, loss or corruption of Content.
You further acknowledge that risks of damage to your software, hardware or stored information may arise due to your use of the Site. CBHS is not liable for any damage or loss incurred by you as a result of using the Site. You are responsible for maintaining the security of your own software, hardware and stored information.
LINKED SITES AND FEATURED COMPANIES
The Site may contain links to websites operated by third parties. Unless CBHS tells you otherwise, CBHS does not control, endorse or approve, and is not responsible for, the content on those websites. CBHS gives no warranty as to the accuracy, currency or completeness of any website or information accessible via links of any form from the Site. CBHS recommends that you make your own investigations with respect to the suitability of those websites. If you purchase goods or services from a third party website linked from the Site, such third party provides the goods and services to you, not CBHS. As with the Site, you accept responsibility for any loss, damage or other consequences resulting from your use of other websites and non-CBHS products in connection with the Site.
INTELLECTUAL PROPERTY RIGHTS
Unless otherwise indicated, CBHS owns or licenses the Content and all intellectual property rights (including any copyright, registered or unregistered designs, illustrations, artwork, patents or trade mark or logo rights and domain names) displayed or used on the Site (CBHS Intellectual Property).
CBHS authorises you to access and use the Site solely for your own personal use and to display, print and download the Content onto your personal device provided that you do not remove any copyright notice included in the CBHS Intellectual Property.
Subject to the above, your use of, and access to, the Site and the Content does not grant or transfer to you any rights, title or interest to the CBHS Intellectual Property. Unless otherwise permitted in these Terms, you must not:
(a) copy or use, in whole or in part, any of the CBHS Intellectual Property;
(b) reproduce, retransmit, distribute, display, disseminate, sell, publish, broadcast or circulate any of the CBHS Intellectual Property; or
(c) breach any intellectual property rights connected with the CBHS Intellectual Property, including altering or modifying any of the CBHS Intellectual Property, causing any of the CBHS Intellectual Property to be framed or embedded in another website or platform, or creating derivative works from the CBHS Intellectual Property.
Nothing in the above clause restricts your ability to publish, post or repost Content or CBHS Intellectual Property, either digitally or in print including on your social media page or blog, provided that:
(a) you do not assert that you are the owner of the Content or CBHS Intellectual Property;
(b) unless explicitly agreed by CBHS in writing, you do not assert that you are endorsed or approved by CBHS;
(c) you do not damage or take advantage of CBHS's reputation, including in a manner that is illegal, unfair, misleading or deceptive; and
(d) you comply with all other terms of these Terms.
PRIVACY
CBHS will collect, use and deal with your personal and health information in accordance with the CBHS Privacy Policy. The CBHS Privacy Policy can be accessed by here.
CHOICE OF LAW
By using the Site you submit to the application of the laws of the State of New South Wales in relation to any dispute arising from or related to the Site.
OUR LIABILITY IS LIMITED
You may have certain rights under the Australian Consumer Law in relation to our Site and the content, and you may contact us for more information about this. Despite anything to the contrary, to the maximum extent permitted by law (including the Australian Consumer Law), CBHS disclaims all and any liability to any party for any loss or damage, whether direct, consequential, incidental or indirect, including loss of profit, arising from the use of, or reliance on, material or information made available through the Site or in connection with it.
Conduct we don’t accept
You must not do or attempt to do anything that is unlawful, which is prohibited by applicable law, which CBHS would consider inappropriate or which might bring CBHS or the Site into disrepute. This includes:
(a) anything that would constitute a breach of an individual’s privacy (including uploading private or personal information without an individual's consent) or any other legal rights;
(b) using the Site to defame, harass, threaten, menace or offend any person;
(c) using the Site for unlawful purposes;
(d) interfering with any user of the Site;
(e) tampering with or modifying the Site, knowingly transmitting viruses or other disabling features, or damaging or interfering with the Site, including using trojan horses, viruses or piracy or programming routines that may damage or interfere with the Site;
(f) using the Site to send unsolicited electronic messages;
(g) using data mining, robots, screen scraping or similar data gathering and extraction tools on the Site;
(h) facilitating or assisting a third party to do any of the above acts;
(i) using, attempting to use, or allowing the digital card to be used by any person who is not entitled to use it under the membership and applicable access processes; or
(j) attempting to circumvent, disable or interfere with any security or verification processes used to protect access to the CBHS Mobile App or digital card.
ENTIRE AGREEMENT
These terms and conditions constitute the entire agreement between you and CBHS as to the use of this Site, CBHS Member Centre or CBHS Mobile App and supersede all prior inconsistent statements or representations.
Additional Conditions of Use of CBHS Member Centre and CBHS Mobile App
These additional conditions apply to your access to and use of the CBHS Member Centre, CBHS Mobile App, and digital card. Your use of the CBHS Member Centre and CBHS Mobile App is subject to these additional conditions and the general Terms and Conditions set out above.
Your use of the CBHS Member Centre and CBHS Mobile App signifies your acceptance of these conditions of use. In addition, your use of these services is conditional upon accepting the Terms and Conditions.
For the purposes of these terms and conditions, password refers to any access code or biometric information (e.g. fingerprint or face) stored on your device to login to the CBHS Member Centre and CBHS Mobile App.
ACCESS TO CBHS MEMBER CENTRE AND CBHS MOBILE APP
Access to the CBHS Member Centre and CBHS Mobile App is generally provided to the main Policy Holder (as defined in the Rules). Where enabled in the CBHS Mobile App, certain features (including digital card access) may also be available to other persons on the membership through CBHS authentication and invitation processes. The main Policy Holder is the person responsible for the payment of contributions for a membership. The main Policy Holder has the right to view, change, add or delete items relating to all persons for whom they pay contributions, subject to applicable privacy laws.
In the event that the main Policy Holder allows access to any other person, the main Policy Holder remains responsible for all transactions conducted using their login credentials. It is the responsibility of the Policy Holder to protect the security of their membership number and password. CBHS is not responsible for any unauthorised use of the Member Centre or CBHS Mobile App that results from the Policy Holder sharing their access credentials.
YOUR OBLIGATIONS
You agree you are responsible for information that you upload or otherwise provide to CBHS via the CBHS Member Centre or CBHS Mobile App and in doing so represent the information provided is true, accurate, current and complete.
If you provide us with another person’s personal information to send them a digital card invite, you warrant that you are authorised to provide that information and that you have informed them CBHS will contact them for the purposes of setting up digital card access, verification and ongoing policy administration (as applicable).
You further agree you will not use the CBHS Member Centre or CBHS Mobile App to access information or perform services related to another person unless expressly authorised to do so.
ONLINE CORRESPONDENCE
By registering for the CBHS Member Centre the Policy Holder agrees to have their mail preference set to email and receive correspondence sent by CBHS electronically.
A new mail notification will be sent to the main Policy Holder’s email address when new correspondence is available in the main Policy Holder’s CBHS Mailbox.
A main Policy Holder can change their mail preference at any time via the CBHS Member Centre or CBHS Mobile App or by contacting the CBHS Member Care Centre.
The main Policy Holder agrees to receive electronic newsletters, promotional offers and other information related to their health insurance. The main Policy Holder can choose to opt-out from receiving these communications by updating their preference on the Member Centre or using the ‘unsubscribe’ option within these communications.
SECURITY
The CBHS Member Centre is protected by industry-standard encryption to help ensure the confidentiality and integrity of information passed between the CBHS server and your browser.
In seeking to use the CBHS Member Centre and CBHS Mobile App, each Policy Holder agrees to assist in maintaining the security of their own information by protecting their membership number and password.
Each Policy Holder further agrees to:
- Use a strong, unique password for the CBHS Member Centre and CBHS Mobile App;
- Not share their password with any other person;
- Change their password upon initial access being granted to the CBHS Member Centre or CBHS Mobile App;
- Keep their password secure and confidential;
- Not allow any person to view their password when logging into the CBHS Member Centre or CBHS Mobile App; and
- Change their password regularly.
The Policy Holder agrees to contact CBHS immediately when they become aware of any inappropriate use of membership details or access to their online details.
GENERAL
Information pertaining to membership made available to a Policy Holder by the CBHS Member Centre or CBHS Mobile App may not always be up to date. For example, Remaining Limits shown (where available) do not take into account any unprocessed claims. However, changes made by a Policy Holder to their membership details will take immediate effect. For example, a Policy Holder will be immediately bound by changes made to their bank account details.
All benefits are payable in accordance with the CBHS Health Benefit Fund Rules, a copy of which can be obtained here or by contacting the CBHS Member Care Centre on 1300 654 123. In the event any information provided by the CBHS Member Centre or CBHS Mobile App is inconsistent with the Health Benefit Fund Rules, the Health Benefit Fund Rules will prevail.
CBHS may cancel, suspend or modify your use of the CBHS Member Centre, CBHS Mobile App or digital card where reasonably necessary for security, fraud prevention, compliance, maintenance, or membership administration reasons (including where a membership is unfinancial or terminated). CBHS will provide reasonable notice where practicable.
The CBHS Mobile App provides access to a digital membership card which displays your current membership information. The digital card may be presented to healthcare providers as proof of membership. You are responsible for ensuring your digital card is only used by persons covered under your membership and in accordance with our digital card terms.
The digital card may be inactive in certain circumstances (for example, if a policy is unfinancial or terminated) and access to digital cards may be limited in some scenarios (for example, where a member has more than one membership). Some features may also be released in stages and may differ by platform.
CBHS may, at any time and at its discretion, vary these Terms by publishing the varied terms on the Site. CBHS recommends you check the Site regularly to ensure you are aware of their current terms.
